Since Nina B. PGB money used for, among other things, private visits to a casino, the Arnhem-Leeuwarden court ruled that Nina B. acted unlawfully. The Court of Appeal also ruled that the municipality of Almelo suffered damage because the former director has made unlawful use of community funds.

Because Nina B did not provide enough evidence to be able to prove the opposite, the Court of Appeal has ratified the earlier judgment of the court.
